About Proposition 65

California's Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) requires businesses to provide warnings when their products may expose consumers to one or more of over 900 chemicals identified by the State of California as causing cancer, birth defects, or other reproductive harm.

A Proposition 65 warning does not necessarily mean that a product is unsafe. Rather, it indicates that one or more listed chemicals may exceed the strict safety threshold set under California law. The threshold set by California law is calculated by determining the “no observable effect level.”  The “no observable effect level” identifies the level of exposure that has been shown to not pose any harm to humans or animals and divides this by 1,000.  Businesses are required to provide a warning if the chemicals exceed 1/1000th of the “no observable effect level,” which is meant to provide an ample margin of safety, but has created thresholds far below any demonstrated risk.  This is why many common household products, foods, beverages, and consumer products sold in California carry Proposition 65 warnings.

We provide this warning in accordance with California law and to provide consumers with the information they need to make purchasing decisions. The inclusion of the Prop 65 warning is meant to disclose that certain substances may be present and should not be viewed as statements of danger or harm.  Many of our products contain trace amounts of chemicals that pose no significant risk or fall significantly below observable effect levels, however, we have chosen to provide the Prop 65 warnings to avoid unnecessary litigation and out of an abundance of caution. 

We strive to provide food products that are nutritional and free from artificial or synthetic ingredients.  Some foods and beverages may naturally contain or be exposed to chemicals included on the Proposition 65 list. These chemicals often occur naturally in the environment, can be absorbed by crops from soil or water, or be introduced during growing, harvesting, processing, packaging, or preparation.  However, our products are safe to consume and fall within FDA suggested guidelines.
